Planning Director Michelle Rambo introduced the ordinance as a first reading; Bob Sweet, legal counsel for the developer/Mark 4 team, said the revenue and rate assumptions are initial estimates for planning purposes. “We took what is going at market now… and used that as the baseline,” Sweet said, characterizing the $24 million annual figure as an estimate tied to market demand and prospective end‑user power purchase agreements.
On questions about who sets rates and franchise fees, counsel said the approach would be to negotiate market‑based power purchase or franchise agreements and that those details would be addressed by the eventual power district board and contracting parties. The item will return for additional hearings and a required second reading in June, and staff noted additional public hearing requirements for the district formation process.
No ordinance adoption vote was taken at this meeting; council discussed next steps and scheduling for required public hearings and the second reading.
