Commission deadlocks on Douglas Road rezoning; forwards 'no recommendation' to County Council

The Area Planning Commission on May 19 was unable to reach agreement on APC 3089‑26, a request to rezone three parcels on Douglas Road from single‑family to commercial. Staff recommended forwarding a favorable recommendation to the County Council provided the developer dedicate 100 feet of right‑of‑way and commit in writing to connect to municipal sewer and water if those utilities become available.
Sean Klein, APC director, said the site sits in an economic development priority area and that commercial uses could serve future employees at nearby industrial or technology projects. "Staff is recommending that this be sent to the county council with a favorable recommendation subject to the right‑of‑way dedication, a 100‑foot, and a written commitment to connect to sewer and water services when available," Klein said.
Nearby residents, including multi‑generation farmers, opposed the rezoning at the public hearing, warning of increased traffic on a narrow road, risks to farm operations from stormwater runoff, light pollution and loss of agricultural character. Joe Leininger, whose family has farmed the land for generations, told the commission the change would alter the rural character and could harm crops from runoff and nighttime lighting.
Petitioners’ counsel said the proposal is consistent with the comprehensive plan and that commercial use near planned industrial development would serve local needs. The commission then considered motions: a favorable recommendation motion failed to pass (insufficient votes), an unfavorable recommendation also failed, and by subsequent vote the APC adopted a "no recommendation" to forward to the County Council. The council will therefore consider the rezoning without a formal APC recommendation.
