The Clayton County Board on May 19 voted to hold a conditional‑use permit application by VP Restaurants, LLC (a Wendy's franchisee) that would add a Global NextGen Wendy's with a drive‑through at 5644 Riverdale Road.
Planning staff presented the site plan and recommended conditions reported by the zoning advisory group (subdivide the outparcel before a land‑disturbance permit; submit a shared‑parking agreement). Nan Wilcox of Carter Hocker Row Group, representing VP Restaurants, said the applicant will lease 0.7 acres and has surveyed the portion needed for the proposed outparcel; Wendy's corporate approved the location as being sufficiently distant from other Wendy's in the area.
Commissioners raised parking questions and reported visible potholes in the adjoining shopping center. Several members asked staff and the applicant to confirm who (the shopping‑center owner or the franchisee) would be responsible for repairs and how responsibilities will be enforced. Staff said their survey covered the parcel Wendy's proposes to lease but not the entire 13‑acre complex and offered to check with Transportation and Development and the shopping‑center owner.
On a motion by Commissioner Hambrick, seconded and agreed by the board, the item was held to the June 16 meeting so staff can provide a written report clarifying acreage, parking responsibilities and any necessary follow‑up with the shopping‑center owner.
