The San Miguel County Board of Commissioners on May 20 approved a one‑step subdivision exemption allowing the vacation of the lot line between Lots 51 and 52 in Fall Creek Subdivision No. 2, creating a single parcel called Lot 51R intended to improve the properties’ buildability.
Associate Planner Nicola Kerr summarized the application and said the combined parcel will be “a little over 1 acre,” increasing the feasibility for at least one house while noting constraints from required setbacks from the river and CDOT right‑of‑way.
Kerr told commissioners the application was referred to the county attorney, county manager, county surveyor and CDOT. The county surveyor submitted six technical comments that the applicants’ surveyor has already addressed; CDOT requires future development to use an existing access easement and obtain an access permit rather than granting direct highway access.
Staff also reported a code compliance issue (dirt moved earlier in the season) and said the applicant is working to remedy that. The approval was conditioned on obtaining the CDOT access permit before construction, securing a wetland special‑use permit to resolve the code violation (CV‑26‑000), and submitting a final plat that satisfies the county surveyor’s comments.
After the public hearing (no remote or in‑room members of the public offered testimony), Commissioner [mover] moved to adopt Board of County Commissioners Resolution 2026‑17 approving the subdivision exemption with the listed conditions. The motion passed unanimously.
Work to address wetland protections and to secure CDOT approvals remains in the applicant’s hands; county staff will verify compliance before issuing any building permits.
