Staff: Franklin Street dam deemed unsatisfactory; restoration plan to DEEP and Army Corps, enforcement letters issued

At the end of the May 13 meeting staff reported that the inlet weir at the Franklin Street dam had been breached and that water had receded upstream. Staff said an inspection determined the dam is in an "unsatisfactory condition" with sinkholes and erosion present and that a restoration plan must be submitted to the state Department of Energy & Environmental Protection (DEEP) and the U.S. Army Corps of Engineers for review.
Staff also reported that four enforcement letters had been issued in recent days to address violations at several properties, including sites on Great Plain Road and Stowe River clearing. One staff speaker said the city has engaged legal counsel to support enforcement, described the standard 10‑day notice process and said the administration is moving forward with restoration and compliance steps.
No formal action was taken during the update; staff said they will continue to coordinate with state and federal agencies and return to the commission as restoration plans and enforcement steps progress.
