The Fremont City Council authorized the mayor to sign a nondisclosure agreement with the U.S. Chemical Safety and Hazard Investigation Board (CSB) related to the agency’s investigation of the Horizon Biofuels incident.
Travis J. Ketts, the city attorney, told the council the CSB requested the NDA to protect confidential business and security information and recommended the council approve the agreement; he said the council could enter executive session if members wanted to discuss the matter more privately. "If there were any questions or discussion on this, I'd ask that we go into executive session," Ketts said, adding otherwise he recommended approval.
Councilman Peterson moved to approve Resolution 2026-098 and Councilman Jensen seconded; the motion carried 8–0.
What’s next: approving the NDA permits the city to share confidential materials with the CSB as part of its investigation, subject to the agreement’s restrictions; Ketts did not describe additional public details in open session.
