South Bend committee approves three scrap-metal license renewals and sends four conditional 60-day interim licenses to evening session

The Community Investment Committee advanced a pair of actions on scrap-metal and recycling business licenses after a multi-department review found three applicants fully in compliance and identified deficiencies at four others that the city said require short-term, conditional oversight.
Michelle Adams, business license administrator in the Department of Community Investment, told the committee she received completed applications and led a review involving the South Bend Police Department, Fire Department, Neighborhood Services and Zoning. She asked the committee to approve Resolution 2613 to issue one-year licenses for three compliant applicants: Omnisource (1305 Prairie Avenue), Steviey's Enterprise (3109 South Gertrude) and Paul's Auto Yard (3300 South Main Street). All three sites were inspected and found in compliance, Adams said.
"These applications underwent a rigorous multi-departmental review," Adams said, adding that inspections confirmed fencing, housekeeping and safe storage of flammable materials.
On Resolution 2614, Adams requested 60-day interim licenses for four other applicants because reviewers found deficiencies that did not justify immediate denial but that require remediation and monitoring. Identified issues included two businesses that were not registered with the police department's Leads Online tracking system (both have since registered), fire-department deficiencies such as overdue alarm or private-hydrant testing, and environmental violations at one site (Alternative 2) related to hazardous tire waste and an active Indiana Department of Environmental Management enforcement case (cause number 71C01-141-PL-000017).
Committee members asked how the city will verify compliance and whether operations must stop if businesses do not comply. Michelle Adams said the city will perform follow-up inspections and that denial and appeals processes exist. City attorney Palmer and Jenna Throw (city attorney) clarified that denial triggers appeal rights and that a full license grant typically requires council action by resolution. Adam Taylor, legal/city staff, explained the draft substitute language that would allow council to grant a full license by resolution upon written notice that conditions have been satisfied and that council may, by further resolution, grant a 60-day extension upon a showing of substantial progress.
Assistant Chief Derek Urkart of the Fire Department outlined common deficiencies: annual fire-alarm testing, proof of private-fire-hydrant testing, and repairs to suppression systems. Adams said the city sent notices and that some applicants have already begun remediation work.
The committee voted to send Resolution 2613 forward to the full council with a favorable recommendation on a roll-call vote. For Resolution 2614, after extended discussion and a planned legal substitute, the committee voted to forward the item to the 7 PM meeting with no recommendation so the substitute clarifying the post-compliance approval process could be filed and considered.
What happens next: the three fully compliant license renewals will go forward to the full council with a favorable recommendation; the four interim-license cases will be revisited at the evening meeting with substitute language about council's role in final approvals and potential extensions.
