Council schedules new public hearing July 20 for Arbors at East Village Phase 2 rezoning
Summary
Planning staff reported revised conditions for the Arbors at East Village Phase 2 conditional rezoning; because revisions were submitted after the prior hearing, council voted to schedule a new public hearing for July 20 and authorized staff to re-advertise.

Planning staff informed the Clayton Town Council on May 18 that the applicant for the Arbors at East Village Phase 2 conditional rezoning submitted revised conditions and a revised concept plan on May 4, after the case's prior public hearing had been closed.
Mr. Tate, representing planning staff, told council the planning board previously recommended approval and that the newly submitted revisions require the council to re-advertise and hold a fresh public hearing. He said staff and the applicant recommended scheduling the new hearing for July 20 and re-advertising the notice.
A council member moved to reschedule the public hearing for July 20 and to authorize staff to advertise; the motion was seconded and the council voted in favor. The council did not take final action on the rezoning request at this meeting; the July 20 hearing will be the next opportunity for public comment and for the council to consider the revised conditions.
What this means: Because the applicant revised the concept plan and conditions after the original hearing record was closed, state and local notice requirements call for a new public hearing so the public and council can consider the revised materials.
Next steps: The council will hear the case again at the public hearing scheduled for July 20; staff will re-advertise the hearing and include the revised concept plan and conditions in the public packet.
