Covington board approves canopy setback variance at 1001 South Tyler with planter condition

The City of Covington Board of Adjustments on May 18 approved a variance for a convenience store canopy at 1001 South Tyler, allowing the canopy to remain in its current, shifted position after a state right-of-way expropriation reduced the property’s front setback.
Staff explained the building and canopy were constructed in the late 1960s or early 1970s before current zoning rules. "The state took the front 10 feet of the property when they widened Tyler Street," Mr. Rodriguez said, describing that the expropriation left the canopy within the right-of-way and created a hardship for the owner when seeking a building permit.
Applicant Andrew Bullock, who identified himself to the board, told members he will remove one pump and operate two dispensers after moving the existing pump closer to the store to provide safer vehicle access. "We're going to remove one, but we'll have two," Bullock said.
Board members and staff clarified that a separate 20-foot strip on the side of the property had been sold previously and was unrelated to the front expropriation. Staff, including the building inspector, public works and the city engineer, indicated they had no objection to granting the variances, and staff suggested the board could impose landscaping conditions to mitigate the paved site.
A board member moved to grant the variance for the canopy location subject to requiring planters flanking both sides of the entrance and landscaping along the left side; another board member seconded. The board recorded affirmative votes from Miss Butler, Miss Williams, Mr. Jenkins and Mr. Lucas, and the motion carried.
The approval applies to Case 26-05-11-U (variance from Appendix B of the City of Covington Comprehensive Zoning Ordinance of 2010 regarding street planting requirements and CN neighborhood commercial front setbacks). The board’s action included specific landscaping conditions to be met by the applicant as part of the variance; staff will follow up on implementation details.
The board concluded the meeting with routine administrative announcements.
