County staff said the amendment requires the landowner to compel either the Town of Rico or the Rico Trails Alliance to demonstrate completion and maintenance of the bridge; the change gives the county an enforcement path through the landowner where previous drafts lacked clear enforcement authority. Nicole, representing the applicant, confirmed the amendment "connects the dots" between existing easement obligations and the town’s ongoing maintenance duty.
Commissioners voted to approve the amended LDA, with the board noting the final execution sequence: obtain signatures from the landowner representatives (including Mike Popc and Alana Karen, as noted), have the county sign, record the fully executed document with the clerk and recorder, and publish the recorded instrument as required.
Board members emphasized the amendment does not change the town’s underlying obligation under a recreation easement but clarifies enforcement steps so the county can ensure compliance. Staff will coordinate final signatures and publishing with the applicant and the county recorder’s office.
The board’s approval completes the county’s final LDA action for the bridge; staff said the document will be recorded and published in the newspaper per county practice.
