Board questions added paragraph in anti-discrimination policy and seeks legal guidance

At the May 19 meeting board members conducted a first read of updated anti-discrimination policies (ACA and AC variants) and focused on a single added paragraph that several members said was ambiguous and could create implementation questions.

The paragraph, which some members said originated at a neighboring district and was added to the policy packet, prompted debate about whether the language would alter how discipline or restroom/locker-room accommodations are decided at the building level and whether it could expose the district to legal challenges. Board discussion centered on whether the paragraph would materially change the policy's effect or simply clarify that existing law controls.

Several trustees asked staff to seek an interpretation from the district's counsel and to provide written guidance before the second read. The board did not remove or adopt the paragraph on May 19; members asked that the policy committee obtain legal advice (Drummond Woodson was cited as a legal adviser that assists the district) and return to the board with a recommendation.

Board members emphasized the need to align any handbook language or disciplinary guidelines with the board-adopted policy and to clarify whether the proposed language assigns decision authority to building administrators. A board member noted the presence of competing state and federal guidance and asked for counsel's view on whether the paragraph would increase litigation risk.
