Council approves Westfield Estates Division 7 preliminary plat after resolving irrigation and drainage conditions

The Bannock County Planning & Development Council approved the preliminary plat for Westfield Estates Division 7, a 12-lot phase that extends existing streets from earlier phases and anticipates future annexation and connection to city water and sewer.
Foster, the subdivision planner, summarized that the phase will extend a stub road from Phase 4, vacate a temporary easement, and follow lot sizes and patterns consistent with earlier divisions. Council members raised multiple technical questions about an irrigation line that runs inside the public-right-of-way and about roadside drainage swales.
Several members said an easement in the center of a public road appeared unusual; staff replied that the irrigation configuration existed in earlier divisions and that the recommended condition would create a 10-foot irrigation easement on Rio Vista and Brighton Lane. Council discussed alternatives—placing maintenance responsibility in CC&Rs and the development agreement rather than creating a mid-road easement. Staff and the council concluded the HOA should be responsible for the irrigation line and any resulting roadway damages; the condition as approved says irrigation lines are ‘‘to be dedicated and maintained by the HOA’’ and that the city or county is not responsible for irrigation lines or damage to the roadway.
A drainage concern was raised about roadside swales and grading. Developer representative Tanner Stenquist said condition 2's language on roadside drainage swales was vague and proposed that ‘‘roadside drainage swales [be] shaped by the developer during final plat and finalized by the homeowner.’’ Council and staff agreed and revised the condition accordingly so that developers build the initial swales and homeowners complete final grading when building their homes.
Conditions approved with the preliminary plat include: CC&Rs reflecting the division name; developer-shaped roadside drainage swales finalized by homeowners; referencing development-agreement and county-variance instrument numbers on the final plat; labeling a 60-foot strip as right-of-way; creation of a 10-foot irrigation easement on Rio Vista and Brighton Lane with HOA maintenance responsibility; 21-foot public utility easements along Brighton Lane for utilities/drainage/roadway slopes; a landscape easement maintained by the HOA; and vacating the temporary turnaround instrument.
A motion to approve the preliminary plat with those conditions passed on roll call, recorded as a 4–0 vote.
