Federal Way council approves 21st Avenue preservation contract, settles quiet-title suit and schedules final action on 16th Avenue vacation

At its May 19 meeting the Federal Way City Council approved several formal actions that advance capital work and resolve property disputes.
Contract award: The council authorized the award of the 21st Avenue Southwest Preservation Project to CPM Development, doing business as Icon Materials, for a base bid of $2,302,838 and approved a 10% contingency of $230,283.80 for a total contract authorization of $2,533,121.80. Christine Mullen, the city’s engineering manager, said five bids were received; the project is fully funded by a National Highway System (NHS) federal grant ($2.59 million) with local match funds and is expected to start in June with an 80-working-day schedule. Council moved, seconded and approved the authorization unanimously.
Settlement: Assistant City Attorney Ken Van Alstine summarized a quiet-title lawsuit filed by the Onishchenkos seeking to vacate portions of public right-of-way near 2nd Avenue SW. The proposed settlement conveys a portion of a historic alley and 10 feet of the western half of 2nd Ave SW to the plaintiffs while preserving the city’s right-of-way interest in the remainder; the Onishchenkos will pay city costs. Council authorized the settlement.
Street vacation: Council considered conditional approval (Council Bill 935) and final approval (Council Bill 938) for vacating a portion of 16th Avenue South to Federal Way Public Schools. Van Alstine reported that the fair market payment (just under $400,000) had been received and the required public-use and parking easement was expected to be executed the following day; the council passed the conditional approval and forwarded final enactment to its June 2 meeting.
Consent agenda and other items: The council also approved routine consent items (minutes, grant applications, interagency agreements, school resource officer interlocal, and procurement authorizations) as a single package.
Why it matters: The 21st Avenue award funds a significant resurfacing/preservation project in a busy corridor and is fully grant-funded. The Onishchenko settlement resolves a long-running title dispute and the 16th Avenue vacation will transfer a parcel to the school district conditioned on recorded easements and payment.
Next steps: Construction on 21st Avenue expected to begin in mid-June; staff will execute the contract and manage construction. Staff will also record required easements for the 16th Avenue vacation and finalize settlement documentation in the quiet-title case.
