CCB says federal rescheduling doesn’t change state licensing; board to monitor guidance

Executive Director Michael Miles and Chair Andre Berry told the Cannabis Control Board that recent Department of Justice rescheduling actions announced on April 28, 2026, raise many questions but do not change Nevada's licensing obligations.
Miles summarized federal developments and emphasized the limits of the board's current guidance. He told members that "federal agencies and the courts are still working through a number of legal and operational issues," and that the CCB's licensing, compliance and enforcement responsibilities under Nevada law remain in place. He also flagged an important state-specific question: how Nevada's dual-license structure under NRS 678.490 will be treated under any new federal framework.
Miles said the board had sent a written update to licensees explaining what the agency currently knows, what remains unresolved, and where licensees should seek legal and tax advice from qualified professionals. "Right now, the board's focus is on gathering information, monitoring developments, and communicating responsibly with Nevada licensees and the public," he said.
Board leadership announced meetings will move to a bimonthly schedule starting in June and that the June meeting will include regulations R152-24 on the agenda for a vote. The board told licensees it will provide further updates as federal guidance becomes available.
The board did not issue new regulatory determinations at the meeting; staff recommended continued monitoring and communication with licensees and stakeholders.
