West Chicago council approves Fabian Parkway intergovernmental agreement with June 1 contingency

The West Chicago City Council on May 18 approved an intergovernmental agreement (IGA) with DuPage County for intersection improvements related to the Fabian Parkway development, adding a new condition that ties the IGA’s effectiveness to timely passage of a development-agreement amendment. The amended motion adds subsection 5(c), which requires passage and approval of the first amendment to the development agreement between the city and 1300 Roosevelt Investors on or before June 1, 2026.
Kelly Chrissy, the city’s director of business and community relations, told the council that DuPage County must still consider the IGA at its transportation committee on June 2 and the county board on June 9, and that building permits for the project will not be issued until the city’s related development-agreement amendment is approved. "It also has to go before the transportation committee at DuPage County and then also has to get approved by the county board," Chrissy said.
Some council members and staff expressed concern about proceeding without the development-agreement amendment finalized. One participant noted the city would be assuming a portion of financial risk if the amendment had not yet passed; staff and the city’s attorney proposed the timing-related subsection 5(c) to protect the city. The council voted on the IGA as amended; the roll-call vote approved the amendment and the resolution.
Under the approved modification, the IGA will only become effective if the development-agreement amendment is passed by the city on or before 06/01/2026; if the required amendment is not enacted, staff indicated the resolution would fail to take effect and the city could withdraw the submission to the county. The county approvals remain outstanding and the development timeline remains dependent on those committee and board actions.
