"The two former employees now retired to the county have been convicted of stealing government funds," a staff member reported. The staff update cited the Pennsylvania Public Employees' Pension Forfeiture Act (Act 140 of 1978) and said it mandates forfeiture of pension benefits that are directly related to funds received in the course of public office. Staff said the individuals will be entitled to counsel in the forfeiture proceeding, restitution may be taken from pension amounts as permitted by law, and staff will notify the individuals next week.
The staff member said cumulative pension payments received to date were below the individuals’ own contributions and that restitution amounts had already been filed. The staff update noted that no board vote was required at this time; staff will continue the administrative steps to effect the forfeiture process.
The board took no formal vote on the forfeiture item and adjourned the meeting after routine closing motions.
