Board approves RM Heiner Construction right-of-way vacation for development parcel

At a public hearing May 11 the Weld County Board of County Commissioners approved a petition from RM Heiner Construction Company Inc. to vacate a portion of road right‑of‑way located southeast of the intersection of North 25th Avenue and O Street. Val Minaud of Public Works presented the legal description and staff recommendation, noting referrals to county departments and outside entities were all supportive and that the county bike path would not be vacated.
Val Minaud said the right‑of‑way originated from an 1871 road viewer’s report and staff found no negative responses from landowners within 500 feet. The petitioner’s representative described the request and the board opened the hearing for public comment; no members of the public spoke against the vacation. Commissioner Maxey moved to approve the right‑of‑way vacation as presented by staff; the motion was seconded and approved by voice vote.
The board recorded the action as approved and closed the hearing; staff will record the approved vacation and proceed with any necessary conveyance documentation.
