Staff explained the subject property and the petition: the existing deck encroaches the interior side yard, and the petitioner seeks to rebuild a slightly smaller deck (6 feet 8 inches by 6 feet) while retaining existing piers and stairs. Staff noted the property was annexed in 1925 and the house dates to 1946; the proposed deck would encroach approximately 6.5 feet into the required side-yard setback. Staff recommended approval subject to conditions limiting the deck’s dimensions, maintaining a minimum 1-foot setback from the interior side property line, prohibiting future enlargement that would increase nonconformity, and requiring building permits and code compliance.
Petitioner Michael Cuddy, who was sworn for the hearing, told the commission he has lived at the address for 35 years and said neighbors to the north and south submitted letters supporting the application. The commission made a motion to adopt staff’s findings and approve the conditional use as conditioned; the vote was recorded and the commission noted that recent village board amendments grant the Planning & Zoning Commission final authority on such accessory-structure relief in single-family districts, making the commission’s decision final for this case.
The petitioner was advised to submit for a building permit and proceed with construction in compliance with village codes.
