Applicant attorney Steven Jones said the family owners want to develop two‑acre lots consistent with nearby parcels and proposed two phases; he asked the board to adopt staff‑recommended conditions and requested one clarifying sentence be added to condition 3 that ties any developer‑constructed Hudgins Road realignment to Phase 2 land‑disturbance permit work.
Owner Robert Mattery described family history and asked for approval to fulfill his father’s vision. Nearby residents including Tim Carter (Jackson’s Creek HOA president) and Chris Bremer spoke in opposition, citing trees, traffic and pedestrian safety and urging that the development be required to fund sidewalks. Carter explicitly requested that a sidewalk along Fisher Spur be required as a condition.
Jones and staff said the applicants agreed to pay for or construct a realignment of Hudgins Road; staff recommended limiting the number of lots to 23 and specifying infrastructure and stormwater conditions, among other requirements. The board read the clarifying sentence into the public record and then voted to approve the rezoning with staff conditions and the applicant’s added sentence tying the Hudgins Road realignment to phase‑2 LDP work. The motion carried on a voice vote.
