Legal counsel (S4) supported the mandate to create an ethics board but advised leaving substantive provisions, penalties and remedial mechanisms to ordinance drafting; S4 warned that overly detailed charter language can produce costly investigations and be used as a political weapon: 'ethics codes can evolve into political slings and arrows,' S4 said, urging that penal-code matters be referred to county or state prosecutors.
Commissioners discussed whether city employees and residents (including potential non-residents) should be able to file complaints and whether the ethics board should have authority to sanction misuse of the complaint process. The commission agreed the charter should mandate the board and the council should craft ordinance-level detail on investigations, sanctions and referrals to prosecuting authorities.
