Council approves alcohol-license resolution for Deerfoot Parkway store after applicant explains plan

The Clay City Council approved Resolution 260503 to allow Liquor Discount Clay to pursue an alcohol license at 6736 Deerfoot Parkway, Suite 102, after the council determined a prior applicant's approval had become inactive.

During discussion staff told the council the earlier applicant ''did not act in a timely manner'' and that the prior zoning approval is only valid for 180 days and had expired. The moderator noted that because the previous application had lapsed, ''there's really no reason for us not to'' approve the current applicant's request. The council brought the resolution back from the table for consideration and then voted to approve it.

Applicant Philip Lagat said he currently operates Chelsea Blues near the sheriff's gas station and told the council he intends to transfer or otherwise address the existing license if he moves to Deerfoot Parkway. ''My name is Philip Lagat and I currently have Chelsea Blues right here by Sheriff gas station,'' he said, explaining he does not own the building at his present location and that arrangements about the license would be handled if he relocates.

Staff clarified the procedural steps that remain: an applicant must hold a valid ABC application and a zoning approval brought to the city, and zoning approvals last 180 days. The council noted the city had sent communications to the earlier applicant by email and mail but had not received a response.

A motion to bring Resolution 260503 back from the table was moved and seconded; the roll call recorded two abstentions and a majority of yes votes and the moderator announced that Resolution 260503 passes.

The council moved on to new business after the action. The council did not amend the conditions of the license at the meeting and staff said any transfer or further zoning steps would follow the city's standard procedures.
