Board continues multiple education rules; three votes advance from law licensing

The Utah State Board of Education on Monday moved to continue several administrative rules following five-year reviews and committee recommendations.

Chair Kerry brought multiple Law Licensing Committee items to the full board, beginning with a reminder that draft materials and recorded committee presentations are available in the meeting backup. The board unanimously approved continuation of R277.750, the rule governing education programs for students with disabilities.

The board then voted to continue R277.604, concerning private school and homeschool scholarship rules and Bureau of Indian Education student participation in public school achievement testing; the motion passed 14 in favor and 1 opposed. Moderator announced, “14 in favor, one opposed. That coming from Member Bogges.” Members asked that staff return the item to Law Licensing for modifications to reflect legislation enacted this year.

On R277.924, the Partnerships for Student Success program, the board approved continuation 13–2; the two opposing votes were identified as Member Earl and Member Bogges. During discussion, board members pressed staff about measuring program effectiveness and whether funds should be reallocated if outcomes are not met.

Separately, R277.322 (local education agency code of conduct) was postponed by the committee; staff circulated draft 4 to board members and the rule will return to Law Licensing for additional review. Deputy Superintendent Elise Newey confirmed the draft had been sent to committee leadership for distribution.

What happens next: board staff will circulate the posted drafts and the committee’s independent materials to members for additional review; items scheduled to return to Law Licensing will be routed for further committee consideration before any board-level final action.
