The council opened and closed a public hearing on an ordinance (No. 2026‑5) amending Title 21 of the Newport Beach Municipal Code and a companion resolution (No. 2026‑30) to implement the housing element by establishing a Housing Opportunity Overlay coastal zoning district.
During public comment, longtime critic Jim Mosier said the overlay is the final step toward implementing the city’s housing plan but warned that the plan—while certified by the Coastal Commission and HCD—may still not yield the amount of affordable housing the city needs under RHNA assumptions. Mosier said the plan’s baseline assumed that 40 percent of entitled units would be affordable and cautioned the city’s remaining obligation could grow if entitlements fall short of that percentage.
Council members asked whether a staff report was needed and, after deliberation and public input, the council voted unanimously to carry the ordinance and related resolution. Staff emphasized that the overlay is a planning tool and that entitlements and construction will be tracked as the city moves forward.
The vote advances the city’s housing‑element implementation steps; staff noted the plan will continue to be monitored and that future entitlements and project-level approvals will affect RHNA compliance.
