Kane County keeps 35-foot roof limit, allows narrow exceptions for non-livable spaces

The ordinance also updates statutory references in Chapter 1 of the land-use code, replacing citations to Utah Code Title 17, Chapter 27A with Title 17, Chapter 79. The commission approved the ordinance on a unanimous vote.
Why it matters: the change preserves the existing maximum building height for living spaces while giving limited flexibility for otherwise non-habitable rooftop structures. The update to statutory references aligns county code citations with current state code language.
The motion to approve Ordinance 2026-09 was made by Commissioner Gwen Brown and carried with all commissioners present voting aye.
