Warrick County BZA gets updates on lawsuit, parking violations and discusses solar/battery storage ordinance

The board's attorney reported a lawsuit by Tiptop Homes had been dismissed after a motion to dismiss; the matter is resolved for now but the attorney said Tiptop Homes may later seek a variance on parking spaces tied to a conversion of a former high‑school building into apartments. Staff reported the converted building was permitted originally for fewer units and that a parking shortfall remains unresolved.
Board members and staff then turned to renewable‑energy topics. Members noted ongoing projects in neighboring counties and rising interest in large solar installations with battery storage. Planning staff said the county does not yet have a specific ordinance for battery storage systems and that drafts related to data‑center and energy facilities will be posted on the Area Plan Commission website before a public hearing scheduled for June 8. A planning staff member said she would post the draft ordinance and supporting materials on the commission’s website and Facebook page and encouraged board members and the public to review them.
The panel discussed safety and technical differences between lithium and sodium‑ion battery chemistries (fire risk differences were mentioned) and said that existing approvals for solar farms may or may not permit battery storage without a zoning amendment or separate application.
The board adjourned after making a motion to close the meeting.
