Public Defender J. R. Santana Carter and Conflict Defender Michael Regan asked the Public Safety Committee on May 6 to formally accept and ratify Allegany County’s participation in the New York State Office of Indigent Legal Services "Fifth Counsel at First Appearance" grant (CAFA502).
The grant provides $215,000 per year for three years for a total of $645,000. County documents state the agreement was signed by the County Administrator or the Chairman of the Board of Legislators prior to formal legislative ratification to meet program deadlines and ensure timely processing of funds. The committee approved a resolution to accept the grant and ratify the prior signature after the County Attorney’s review.
Conflict Defender Michael Regan told the committee his office has hired three employees and is no longer in a critical staffing situation. The ratification will allow the county to proceed with grant implementation under the terms presented.
The committee approved the ratification on a motion by Legislator Healy, seconded by Legislator Bessette; staff were directed to prepare the resolution for the Legislature. The grant will be subject to review and any required compliance steps by the County Attorney and appropriate departments.
