The Leawood Board of Zoning Appeals approved an exception May 27 allowing a 6‑foot fence at 8909 High Drive after the homeowner amended the request to include the north property line.
Tim Castaneda told the board neighbors to the east requested the fence because his backyard slopes downward toward them, creating elevated sight lines into their living areas and porches. Castaneda said certified notices were sent and that he had neighbor support, including written email support in the packet. He also said the family plans a hot tub and later a pool; a 6‑foot fence would provide privacy and avoid a second petition after pool permitting.
Board members discussed the applicant’s justification and whether the north side should be included; staff said an amendment to include the north side could be approved as part of the motion. The board voted to approve the exception with the amendment to include the north side; the chair indicated the applicant will be notified in writing.
The approval allows the property owner to install a 6‑foot privacy fence on the amended sides of the lot, subject to any conditions in the written notification and applicable permitting.
