Supervisors authorize civil complaints to seek court orders against properties and 3 Star Home Care

The Lower Paxton Township Board of Supervisors voted on March 3 to authorize the township solicitor to file civil complaints in the Court of Common Pleas in Dauphin County against four properties listed on the agenda and against 3 Star Home Care Services LLC. The complaints seek injunctive relief and reimbursement of fees and costs if the properties remain out of compliance with township zoning and code-enforcement orders.

Solicitor Hall said these filings are a next step "anytime that the township is trying to obtain compliance with either zoning or code enforcement issues" after notice and magistrate (MDJ) proceedings have failed to bring about compliance. "The goal here is compliance at the end of the day," Hall said.

Chairman Campbell moved the matter to the solicitor for presentation; a supervisor moved to authorize the filings, another seconded, and the board voted in favor. During discussion, one supervisor asked about the location of 3 Star Home Care Services LLC; Solicitor Hall identified the entity’s address and the property under review.

What the authorization allows: the solicitor’s office will file complaints seeking injunctive relief and reimbursement of township costs if property owners do not comply after the complaint is filed. The board did not direct immediate abatement or specific remedies; rather, the authorization permits the solicitor to pursue court action where administrative notices and MDJ fines did not resolve violations.
