The Millcreek Township Board voted March 24 to participate in a proposed remnant settlement in the national prescription‑opioid litigation, accepting documents that would allocate settlement proceeds to participating government entities.
Township solicitor Attorney Shaw said the remnant defendants agreed to pay $97,625,000 into a settlement fund. Under the proposed allocation formula described at the meeting, the township’s allocation is roughly $250,000; Erie County’s share is projected at about $7,000,000; the city at about $800,000; and the district attorney’s office about $700,000. Shaw said Pennsylvania is a participating state and that funds will be administered initially by the state, then distributed to counties and municipalities, with uses limited to an approved list of opioid‑remediation activities.
Shaw recommended the board sign and execute the settlement documents provided the remnant defendants achieve sufficient participation. The board approved participation and execution (motion by speaker 4, second by speaker 3; unanimous vote).
Shaw cautioned finalization depends on the remnant defendants and court approval; he described the settlement as one more step in a series of agreements in the larger litigation.
