Fairhope City Council approved the site plan for a Foosackley’s restaurant to be located on a 1.52-acre parcel on State Highway 181 north of State Highway 104.
Staff told the council the application is unchanged from the plan the council approved on March 10, 2025, but the developer did not obtain a permit within the required 365‑day window so the matter returned for reconsideration. Planning commission had unanimously recommended approval without conditions after previous conditions were resolved.
A representative for the applicant, identified in the meeting as Hunter, described the proposed tenant’s product mix (milkshakes, frozen desserts and chicken fingers) and noted the developer had earlier disagreements over a pad site, but said the concept was successful in other nearby locations.
Chair called for a motion; the council moved and seconded and approved the site plan by voice vote. Staff will follow up with formal issuance of the approval and permit paperwork.
The decision restores the council’s previous approval for the same site plan and permits the applicant to proceed through permitting and construction steps under the approved design.
