The Village Board approved a package of actions May 26 clearing the way for the Winding Creek Estates residential development.
Planning staff described the project as a mixed single‑family, attached townhome and multifamily development. The applicant received preliminary PUD approval in February 2025; because construction had not begun within one year, the developer requested an extension. The board approved a 15‑month Planned Unit Development extension to accommodate bidding, winter, and a spring start.
The final subdivision plat was approved with staff conditions including a required stormwater management report and erosion control plan, confirmation of rear yard drainage for specified lots, a potential stormwater facility for additional lots, a 30‑foot easement for a Newwater interceptor sewer if needed, and payment of $46,004.95 in park fees.
Staff also presented and the board adopted a development agreement that defines utility, road and infrastructure responsibilities, construction warranty and a completion guarantee secured by a certificate of deposit at 120% of the required amount. The board approved recommended exhibit additions (exhibit C: improvements chart; exhibit D: financial institution info for the completion guarantee) and removed a requirement for a personal guarantee after staff review.
Separately, the board approved an amended developer performance agreement timeline for a different parcel sold to MultiPond America, moving submittal and construction deadlines out to 2027–2029. Under that amendment MultiPond must submit site plan/design review materials by 03/31/2027, commence construction no later than 11/01/2027 and obtain a certificate of occupancy by 02/01/2029, or risk the village pulling the property back under the development agreement terms.
What happens next: Staff will monitor compliance with the development agreement and the phased action items; Brown County Planning Commission approval was identified as a required next step for the final plat.
