The Spalding County Planning and Appeals Commission voted to return two technical ordinances — the Soil Erosion and Sedimentation Control Ordinance and the Illicit Discharge and Stormwater Connection Ordinance — from Part 8 of the Unified Development Ordinance into Appendix C and Appendix D of the zoning code, respectively. Staff said these moves reflect decisions made during prior Article 1 updates and do not change substantive requirements.
Mr. Allen explained that the erosion ordinance was inadvertently deleted from Part 8 during earlier edits and is being restored to Appendix C; the stormwater ordinance likewise will be placed in Appendix D. No members of the public signed up to speak on either item.
A commissioner asked about appeal timelines for stormwater enforcement (the packet showed a five‑day appeal period and a 15‑day board hearing requirement); staff recommended retaining the shorter timetable for stormwater cases so the board can act quickly on ongoing stormwater damage and enforcement actions. The commission approved both placements with no recorded opposition. Staff said the ordinances will be posted to Municode and that final administrative steps follow Board of Commissioners action as needed.
