Zoning board tables rehearing on Majestic Pools enforcement action, attorney requests full records

The Town of Lancaster Zoning Board of Appeals voted to table a rehearing concerning a final notice of violation and order of remedy for Majestic Pools at 4370 Walden Avenue after the code enforcement officer presented a lengthy history of the site and the property’s past permits and enforcement actions.
Matt, the town official who presented the history, said the record includes rezoning and multiple structure permits dating to the 1970s and 1980s, notices and ordered remedies for open storage and unregistered vehicles in the 1990s, and local-law changes addressing salvage yards and abandoned vehicles. He said the December interpretation of the code enforcement action should be reconsidered in light of the site’s historical operations and adjacent uses.
Charles Grieco, attorney for Majestic Pools, said he received only a fraction of the documents recited by the code officer and requested the full packet; he asked that the board adjourn consideration until counsel could review the materials and prepare an informed response. The attorney specifically cited missing historic notices, court records and local-law materials referenced in the presentation.
Board members agreed it was fair to give the attorney time to review materials. The board moved and seconded to table the case until the April meeting and recorded a unanimous roll-call vote (seven yes, zero no). The board additionally voted to enter an attorney–client privileged session to discuss pending litigation.
The rehearing was tabled; the board asked that the town provide the materials relied on by the code enforcement officer in advance of the next hearing so both parties have the same documents for review.
