Council reviewed an amendment to an easement related to a new apartment complex; council members asked the city attorney and staff to make edits to the document to limit access to emergency vehicles only.
A city attorney read proposed red-line edits clarifying that the easement "shall run with the respective lands...providing emergency fire access for emergency vehicular ingress and egress" and that only the grantee and emergency vehicles may utilize the easement in the event of a fire emergency. The amendment also requires the grantee to maintain and repair the easement surface and to take measures to prevent public access to the easement area.
Council asked staff to prepare a short paragraph version of the amendment for ease of reading on the floor, and members confirmed the intent was to ensure the access road is for emergency access only and not general ingress/egress.
