The commission was presented with a set of subdivision plats that appear to divide parcels under the lake’s high-water mark. Staff reported many of the submitted plats rely on a 2009 survey that was never recorded; several parcels shown on the plats appear to be underwater and lack road frontage, access, or utilities.
Commissioners and staff said the submissions do not meet ordinary subdivision criteria and raised questions about title, TVA inundation and whether owners can record or sell lake-bottom parcels to adjacent landowners to secure docks. One commissioner noted, “Everything outside of the purple line is underwater,” describing the visuals staff provided.
Several participants urged caution: staff and the county attorney will review the deeds, the applicability of TVA and federal inundation condemnation, and the legal path (for example combining underwater strips with adjacent upland parcels) before the commission takes any formal action. Staff was asked to bring back legal advice and administrative guidance at a subsequent meeting.
