Bessemer authorizes 11 separate water-tank maintenance contracts citing ADEM rules

The Bessemer City Council voted Jan. 13 to authorize Mayor Kenneth E. Gulley to execute 11 separate water storage tank maintenance and inspection agreements with American Tank Maintenance, LLC, covering Woodland Hills; Maxwell; 15th Street; Hueytown Tank No. 1; Hueytown Tank No. 2; Lipscomb Tank No. 1; Lipscomb Tank No. 2; Sparks Gap; Red Ore; Holbrook; and Ross Bridge.
City Attorney (referred) Attorney Killings told the council the agreements are structured separately because each tank has individual service needs and noted that ADEM Administrative Code Rule 335-7-7-.04 establishes comprehensive maintenance, inspection, disinfection, documentation and reporting requirements for public water-system tanks. "Water storage tanks are required to be maintained on a consistent schedule," Attorney Killings said.
Councilor Teco Stephens asked whether the 15th Street tank would receive scheduled maintenance; Mayor Gulley said that tank is fairly new and "doesn’t require service at the moment." Stephens also asked whether prices might change year to year; Attorney Killings said price adjustments are possible under the extended service arrangement but the city retains an option to opt out.
Bessemer Utilities Director Jerry Yarbrough said the Woodland Hills tank is scheduled to be fully rehabilitated this year. The resolution directs that services must comply with the Maintenance Standards referenced in the ADEM rule and authorizes city officials to take further actions necessary to carry out the agreements.
The council approved the resolution on a unanimous vote. The resolution states that the cost for services will be set forth in each individual agreement and will be paid from lawfully available funds of Bessemer Water Service/Bessemer Utilities.
