WPCA authorizes subordination of unused sewer easement to EPA land-use restriction at 170 Beacon Point Road

The Stratford Water Pollution Control Authority voted to subordinate a town sewer easement to an environmental land-use restriction (ELUR) placed on 170 Beacon Point Road after an EPA remediation.
Town Engineer Mr. Casey explained that the EPA performed cleanup work on part of the property and is recording an ELUR that will impose restrictions if future digging is required. The town’s sewer easement remains in the land records but the pipe that formerly occupied the easement is no longer in service and there is no currently foreseeable need to use it.
Mr. Casey said that subordinating the town’s rights to the ELUR will subject the town to the same notification and restriction requirements should future excavation be necessary. He told the authority there is no current facility in the easement and no immediate operational issue, and the board approved authority to sign the subordination agreement.
Members asked clarifying questions about the future use of the parcel and whether the easement abuts other sites; staff replied the parcel abuts the treatment plant and that while future needs are unlikely, the easement will remain on record in the event conditions change.
