The Smithtown Planning Board on Dec. 3 approved a 180‑day extension of conditional final approval for subdivision no. 1194, known as Cox Estates, moving the approval’s expiration to May 2, 2026.
Planning department staff told the board the two‑lot subdivision received conditional final approval on May 7, 2025, and that the approval lapsed on Nov. 3, 2025. The applicant submitted a request for an extension on Oct. 8, 2025; staff recommended a 180‑day extension to allow additional time to file the final map.
At the meeting, James Fox, who identified himself as an agent for the owner, said the delay stemmed from additional work required by the Board of Health, including “an abandonment and a new pool on an existing house,” and that the applicant expected to complete the remaining tasks within the requested extension period. Fox also submitted an affidavit of posting to the record.
Hearing no public comment, the board closed the hearing, moved to adopt the planning department’s resolution as read and voted to approve the extension. No oppositions were recorded in the transcript.
The extension is administrative: the board’s action prolongs the deadline to file the final subdivision map; it does not change the conditions imposed at the time of the original approval. The board indicated the new expiration date will be May 2, 2026.
