Nibley planning commission approves electronic fuel-price sign at Maverick

The Nibley Planning Commission on March 19 approved a conditional use permit and an electronic message display sign permit for a monument sign proposed for the Maverick Fuel Station at 390 South Highway 165.
Levi, a city planner, told commissioners the applicant (represented by Yesco) resubmitted revised plans that addressed earlier deficiencies and that staff recommends approval. "Staff's recommendation is is approval of this EMD sign permit and and conditional use permit," Levi said. He said the updated proposal is a 20-square-foot monument sign set back 13 feet from the sidewalk, meeting the city code minimum of 10 feet.
The sign will display fuel prices and limited alternate text (for example, switching between "nitro" and "credit"). Staff and the applicant confirmed the display transitions were changed to meet the four-second minimum required by Nibley city code; one commissioner noted earlier versions showed three-second transitions. Commissioners also discussed whether the sign could be a safety distraction; Levi and other commissioners said the sign is limited to fuel prices and brief alternate text, not general video. "It's not like a screen that you know displays some kind of video or anything like that," one participant said.
Commissioner Claire moved to approve the conditional use permit and EMD sign permit; the motion was seconded and passed by voice vote with all in favor. Staff noted the applicant has submitted a building permit and staff will coordinate with the building inspector to finalize the process.
The change follows a city council amendment in recent months that expanded where EMD signs are allowed in commercial zones, enabling the Maverick site on Highway 165 to apply. The developer packet originally listed 28 square feet, but staff said the submitted sign is 20 square feet and therefore within the monument-sign size limit. The building permit review will verify final technical compliance with brightness, frame effects, dwell time, and other code standards.
Next steps: the applicant must complete the building-permit process and meet any related building-inspection conditions before the sign may be installed.
