Commission adopts contested-case recommendations, posts rule changes for comment and confirms personnel moves

General Counsel Phil Atkins summarized six contested cases: four involved the vehicle inspection program (recommendations included 12-month suspensions or a $500 administrative penalty), and two were in the private-security program (recommendations to summarily deny applications where federal or statutory disqualifications applied). Commissioner Blair moved to adopt the SOAH recommendations and Commissioner Long seconded; the commission voted to adopt the proposals.
The commission also approved publication in the Texas Register of proposed rule changes. Chief Sherry Gibson presented proposed amendments to 37 TAC 15.25 to add parole officers, probation officers, designated court staff and their family members to the address confidentiality program. Chief Wayne Mueller summarized a package of regulatory amendments across the Regulatory Services Division to standardize lawful-presence verification using DHS-evidentiary documents; commissioners approved publication for public comment.
On ongoing business, the commission adopted previously published driver-improvement amendments to 37 TAC 15.82'15.85 (no public comments were received during the publication period), following a recommendation from Chief Gibson.
On personnel, Colonel Martin presented two recommended hires. The commission approved the appointment of Conrad Swan as assistant chief of the finance division and approved Billy Jack Mims as regional chief for Central Texas. Motions to approve each appointment passed unanimously.
Commissioners then approved the consent docket and adjourned after executive session.
