Luna County approves Little Toad Creek Distillery wine-grower license after no public opposition

Chair read statutory notice requirements and opened the hearing; the county attorney reviewed the statutory grounds for denial and reported none applied. "You can only reject the application if the proposed location is within an area where alcohol is prohibited by state law," the county attorney said, and confirmed zoning and other county ordinances did not bar issuance. Staff also noted the county is under quota for liquor licenses and would not exceed state limits.
No members of the public registered to speak against the application. With no public opposition, a commissioner moved to approve submission of the completed application; a second followed and the board voted by roll call. Commissioners voted yes (unanimous) and the motion passed.
The commission's action authorizes the county step required under statute to forward or approve the application for the wine-grower license; the county attorney had earlier confirmed notice publication in the Deming Headlight and certified-mail receipt by the applicant as required.
