General counsel proposes delegating prehearing motions under revised policy 4.101

Helen Torres, a senior attorney in the Office of General Counsel, presented proposed revisions to policy 4.101 (rules of procedure) to the School Board, describing four primary changes intended to streamline administrative hearing processes.
Torres said the revisions would authorize the general counsel to rule on pre-hearing motions, provide that initial denials or dismissals by the general counsel be issued without prejudice with at least one opportunity to file an amended petition, require prompt notice to parties that includes reasons and filing deadlines, and add a purpose statement for consistency and clarity. She noted the policy will be amended to conform with policy 2.57 regarding charter schools.
Torres said policy development is scheduled for July 15 and policy adoption on Sept. 9 unless the board requests additional changes or discussion.
No board member raised substantive questions in the workshop; the chair closed the presentation and moved to adjourn the workshops into a special meeting.
