Davison County Board of Adjustment approves two setback variances

The Davison County Board of Adjustment voted Jan. 14, 2025, to grant two zoning variances affecting setback requirements for properties in Davison County.
Vice Chairman Michael Blaalid called the meeting to order at 9:15 a.m. and noted that all board members were present except Chairman Reider. Planning and Zoning Deputy Administrator Wegleitner and Auditor Kathy Wingert were also in attendance. The board approved the meeting agenda and the minutes of its Dec. 10, 2024, meeting before taking up variances.
The first variance, requested by Ken Johnson, would reduce the minimum front-yard setback in the Agricultural Residential District. The board moved, on a motion by Claggett seconded by Nebelsick, to grant a variance of approximately 45 feet that would result in an approximate front-yard setback of 30 feet where the code ordinarily requires 75 feet. The Planning Commission had recommended granting the request by a 6-0 vote with one member absent. The board recorded a roll call vote with Claggett, Blaalid, Kiner and Nebelsick voting aye and Chairman Reider absent; the motion carried.
The second variance, requested by Troy and Annie Haag, sought removal of shelterbelt setback requirements on two property lines. The motion by Claggett, seconded by Kiner, granted variances of roughly 75 feet on the north and west property lines that would create setbacks of approximately 0 feet where 75 feet is normally required for shelterbelts in the Agricultural District. The Planning Commission recommended approval with the removal of the active requirement referenced in Section 12:06(B)(6) of the Davison County Zoning Ordinance. The board again recorded aye votes from the four members present (Claggett, Blaalid, Kiner and Nebelsick) with Reider absent; the motion carried.
Meeting materials filed with the board note application receipt dates and public notice steps: Ken Johnson's application was received Dec. 9, 2024; notice was published in the Daily Republic on Dec. 28, 2024, and Jan. 2, 2025, signs were posted Dec. 27, 2024, and abutting property owners were notified Dec. 24, 2024. Troy and Annie Haag's application was received Dec. 20, 2024, with similar publication dates and notices listed in the agenda packet. Each variance was processed pursuant to provisions of the Davison County Zoning Ordinance (see sections cited below).
The Board of Adjustment adjourned at 9:21 a.m. on a motion by Nebelsick, seconded by Claggett. Auditor Kathy Wingert attested to the meeting minutes.
