Rindge ZBA approves deck setback variance for Fortier property on Red Gate Lane

The Rindge Zoning Board of Adjustment on Aug. 20 approved a variance permitting a rear deck at the Fortier property on Red Gate Lane to extend into the regulated setback. Chair Kevin Sawyer read the case (No. 2029) into the record and the applicant described the proposed porch as roughly 24 feet by (dimensions provided in the application), with stairs at the southwest corner that trigger the setback request.

The board reviewed Article 4, Section B of the zoning ordinance (frontage, yard and area requirements) and asked the applicant questions about distances to neighboring property lines and the deck’s footprint. Board members noted the structure’s location relative to adjacent properties and the applicant said the remainder of the house and site would remain unchanged and largely forested.

A motion to approve the variance “as written in the application” using the five criteria was made and seconded; the board voted in the affirmative and the applicant was instructed that an approval letter with details would follow. The chair told the applicant they should receive written confirmation of the approval soon.

The decision permits the applicant to construct the deck consistent with the variance conditions and the board recorded its vote in the meeting minutes. The applicant was advised on any next steps and to expect formal notice of the approval.
