The Board of Commissioners of Jay County, IN is seeking review of a proposed System Support Agreement with CSI (Computer Systems, Inc.) that would provide hosted-server maintenance and support for calendar year 2026 for an annual fee of $5,500.
According to the contract text contained in the submitted materials, the agreement would take effect Jan. 1, 2026 and automatically renew for successive one-year terms unless either party gives written notice at least 90 days before expiration. CSI’s stated responsibilities include two-hour response time to support calls during business hours, system tuning, disaster-recovery reloads from customer-created backups, telephone and remote-access support and reloading or reconfiguring server software in case of software malfunction.
The contract sets service-availability hours at 8 a.m.–5 p.m. Eastern, Monday through Friday, and lists discounted out-of-scope hourly rates for normal-hours work ($85 per hour) and premium rates for weekend/after-hours and holiday work. The agreement allows CSI to adjust charges at renewal and imposes a 10% bookkeeping surcharge if the county elects monthly or quarterly invoicing rather than annual invoicing.
The draft places responsibility for data backups, antivirus/malware/ransomware defenses and software licensing on the Customer; CSI disclaims liability for data loss resulting from customer backups, faulty media or customer security lapses. Service exclusions include unapproved modifications, on-site workstation support, software updates, training and hardware repair unless separately contracted. CSI limits damages for any claim to the amount paid for one year of maintenance related to the cause of action and disclaims consequential damages.
The contract text also states CSI’s enrollment in the USCIS E-Verify Program (Company ID #483133) and includes nondiscrimination and certification language required under Indiana statutes; it designates arbitration under the Indiana Rules for Alternative Dispute Resolution with venue in Fishers, Indiana. The transcripted signature block and dates appear fragmented or inconsistent in the submitted copy.
A separate county procurement form titled “REQUEST FOR REVIEW OF PROPOSED COUNTY CONTRACT,” dated Oct. 17, 2025 and citing Indiana Code 36-2-2.8 and 36-2-2.9, accompanies the contract. The form states that funds have been appropriated and procurement rules have been followed and lists “Recorder County Office Milame Lipp” as the county officer on the form. The form is marked as received by the Jay County Auditor’s Office on 10-17-25.
Next steps: the request-for-review form was submitted to the auditor on Oct. 17, 2025; further action by the Board of Commissioners (approval, amendment or rejection) is required for the agreement to become effective. The submitted transcript does not show a completed board vote or an unambiguous, fully executed signature page.
