Jefferson County approves participation in nationwide opioid remnant-defendant settlement

Jefferson County's Board of Legislators voted April 7 to participate in a proposed combined settlement that would resolve opioid-related claims against six remnant defendants (Associated Pharmacies, J M Smith Corporation, Louisiana Wholesale Drug Company, Morris and Dickson Co., North Carolina Mutual Wholesale Drug Co., and United Natural Foods, Inc. and affiliates). The settlement would allocate approximately $97,625,000 nationwide among participating jurisdictions.
The resolution, introduced by Legislator Steel E. Potter, says Jefferson County did not need to have filed suit to receive a portion of the settlement proceeds and directs the County Attorney and/or County Administrator to execute documents, including the required releases. The county's outside opioid litigation counsel recommended participation and the County Attorney reviewed and concurred with that recommendation.
The resolution passed with a single nay vote (Legislator Jareo) and otherwise recorded ayes. The resolution directs county officials to complete required paperwork to effectuate participation and the release of claims against the named defendants.
The settlement and resulting distribution would be administered under the terms negotiated in the larger multi-defendant agreement; the county did not specify its anticipated share amount in the meeting materials.
