Clay ZBA approves Webb family’s shed setback variance

The Town of Clay Zoning Board of Appeals on Jan. 12 unanimously approved an area variance allowing William and Sahra Webb to replace an existing shed at 5225 Cremona Trail with a new 10-by-16-foot shed that will be located 2.5 feet from the side property line instead of the 7.5-foot requirement.
William Webb appeared and explained the request. He said the new shed replaces an existing structure and that no electricity will be run to the replacement unit.
"The shed would not have electricity," Webb said when asked by Deputy Chairperson Karen Liebi.
Webb addressed the standards of proof, stating the replacement would not alter neighborhood character, other alternatives were not feasible, and that the need for the variance was self-created. Planning and Development Commissioner Brian Bender reminded the applicant that a building permit will be required if the variance is approved.
Member Ryan Frantzis moved to approve the requested area variance subject to substantial compliance with Exhibit "A." The motion was seconded by Member Mary Lou DesRosier and carried unanimously.
The board’s approval is conditioned on substantial compliance with Exhibit "A"; the applicant must obtain any required building permits before construction begins.
