Homeowner Joe Miller told the Lincoln City Council on March 16 that two city-owned trees identified by Parks and Recreation as rotten caused repeated property damage—one tree fell on his house in July 2024 and a second marked-for-removal tree fell Aug. 9, 2025—and that he is asking the city to reimburse $8,939.81 not covered by insurance.
Miller said city staff inspected and marked several trees as hazardous after the first fall but that removal was delayed until Jan. 22, 2026. He told the council his insurance paid $5,681.32 and he is seeking the balance to cover replacement of a shed, fence and contents he described in an itemized packet filed with the clerk.
"I made aggressive contact with parks and recs," Miller said, arguing the city had prior knowledge of the trees’ condition and therefore should consider reimbursement beyond depreciated value.
Council members asked for specifics about the estimate and insurance payments. City Attorney Yancy Christie explained the central legal issue is market value versus replacement cost under Nebraska negligence law, and that the attorney’s office had not yet seen documentation demonstrating unreimbursed losses. Christie said the office would revisit the claim if Miller provides additional documentation.
Councilman Duden moved to place Miller’s claim on the pending list so the attorney’s office could review new materials; the motion was seconded and approved on a 7-0 roll call. The council did not make a substantive finding of liability; the pending status directs staff and the city attorney to review the claimant’s newly submitted documents and report back.
Separately, resident Jamal Murad presented a claim that a city tree branch fell on his car Nov. 25, 2025; Assistant City Attorney Sarah Rada said forestry records showed no prior reports that would have put the city on notice and recommended denial.
