Commission issues negative determination for tree removal on Mill River, requires three understory plantings

The Northampton Conservation Commission on May 14 issued a negative determination for a request to remove a large pine tree near the Mill River at 66 Federal Street, conditioning approval on mitigation plantings and preservation of the root structure.
Staff presented the RDA for applicant Hannah Ray, who was not present. Commissioners noted photographs showing a previously fallen pine on the parcel and discussed whether a removal would alter the riverfront resource area under the Wetlands Protection Act or the local wetlands ordinance. Concerns centered on potential loss of shade (which affects water temperature), the stabilizing role of interconnected tree roots on the bank, and the lack of understory vegetation along a mowed lawn that currently reaches the river edge.
Commissioners recommended mitigation rather than outright denial. They proposed leaving the stump and root structure intact, and requiring plantings to encourage native understory and compete with knotweed, which proliferates when mowing stops. Species suggested by commissioners and staff included dogwood, buttonbush (Cephalanthus occidentalis), winterberry, holly, serviceberry and American hornbeam. Commissioners discussed using a discrete requirement of three understory trees from a staff‑provided list to allow for typical early mortality and to restore near‑bank vegetation.
The commission moved to issue a negative determination (checking box two) conditioned on: (1) planting three understory trees chosen from a list provided by staff, and (2) not removing the tree’s root structure. The motion was seconded and passed by roll call (commissioners voted yes: David, Paul, Mason, Beth, Downing and Melissa). Staff will provide the planting list to the applicant and include the conditions in the determination letter.
Next steps: Staff will send the negative‑determination documentation and the planting list to the applicant; the applicant must comply with the planting and stump preservation conditions.
