Authority staff attorney Victoria Church told commissioners the statute requires the authority to adjust the required community access support per subscriber no later than June 1 each year using the Consumer Price Index. For the current year, Church said the applicable inflation rate is 3.25 percent, which yields a statutory amount adjusted for inflation of $11.86 per subscriber. The authority noted the statute permits adjusting the amount up or down by up to 40 percent based on certain criteria; the panel chose not to change the CPI-adjusted amount beyond the inflation calculation.
Church said the authority will notify MVPDs and community access providers of the adjusted amount and ordered community access providers and advisory councils to file annual reports. A motion to adopt the decision was moved and seconded; Mr. Bumpin called the roll and the five commissioners voted yes.
The authority set the 40% plus-or-minus statutory range between $7.12 and $16.60 and left the CPI-adjusted amount unchanged. Commissioners thanked staff for their work on the docket and proceeded to the meeting's consent calendars.
